General Terms and Conditions of Swiss Language Academy (SLA Basel) for Private Lessons (gültig ab 1. Januar 2022) 

By registering, you accept and agree to the following general terms and conditions of SLA Basel. 

1. General 

The cost of course materials is not included in the course fee. These will be listed separately on the invoice. They amount to a flat rate of CHF 50. Participants will generally receive teaching materials and other documents in the form of copies. 

2. Registration and payment terms 

By registering, participants confirm that they have read and agree to these general terms and conditions. In all other respects, the provisions of the Swiss Code of Obligations apply. 

Registration is binding. Once participants have registered for a course, they will receive confirmation of registration from SLA Basel. The lessons booked are valid for 12 months, i.e. one year, from the date of registration. During this period, the lessons booked can be taken at any time. This also corresponds to the contract period. 

Once the desired private lessons have been organised, participants will receive the invoice by email. The payment date stated on the invoice is binding. Upon request, the course fee can be paid in instalments. In the case of instalment payments, the first instalment is due at the start of the course. The remaining instalments are to be paid monthly in accordance with the payment schedule. Registration and course organisation by SLA Basel obligate participants to pay for private lessons. In the event of cancellation up to 14 days before the start of the course, the participant must pay 50 per cent of the course fee (see 5. Cancellation of private lessons before the start of the course). Failure to pay the course fee does not constitute cancellation. In the event of late payment, SLA Basel reserves the right to charge CHF 20 for the 2nd and 3rd payment reminders. If payment is still not made, SLA Basel reserves the right to take legal action. 

The discount with the Caritas KulturLegi is only valid for group courses and not for private lessons. Vouchers from the canton of Basel-Stadt for new residents can also only be redeemed for group courses and not for private lessons. 

3. Materials owned by Swiss Language Academy 

If Swiss Language Academy provides materials on a rental or loan basis, these remain the property of Swiss Language Academy for the entire duration of the rental period. The establishment of liens and retention rights in favour of third parties on this material is expressly prohibited. In the event of seizure, retention or attachment, you are obliged to inform Swiss Language Academy immediately and to notify the relevant debt enforcement or bankruptcy office of Swiss Language Academy's ownership. Upon termination of the service, you are obliged to return the material undamaged and within the period set by Swiss Language Academy to Swiss Language Academy. If you fail to comply with this obligation, Swiss Language Academy reserves the right to charge you for the material that has not been returned. 

4. Consultation 

The SLA Basel is happy to advise interested parties at its office or by telephone. Participants can also take a placement test on the SLA website. The test and consultation are free of charge and non-binding. 

5. Cancellation of private lessons before the course begins 

Once private lessons have been organised and confirmed to the participant, free cancellation is no longer possible, as the course, premises and teachers have already been arranged. SLA Basel expressly reserves the right to claim damages (the lost course fees) in the event of cancellation in accordance with Art. 404 para. 2 of the Swiss Code of Obligations. If cancellation occurs up to 14 days before the start of the course, the participant must pay 50 per cent of the course fee. If cancellation occurs less than 14 days before the start of the course, the participant must pay the entire course fee. 

6. Interruption or termination of private lessons after the course has started 

If a course is interrupted during individual lessons, the lessons remain valid until the end of the contract (contract length 12 months from the start of the course). During this time, the course can be continued at any time until the end of the contract. In the event of cancellation, you are obliged to pay the full course price, as our teachers are committed to providing the courses and Swiss Language Academy would otherwise suffer considerable damage. 

7. Postponement of appointments and absences from private lessons 

The agreed lesson times are binding. If the course participant is unable to attend the lesson as agreed, they must cancel 24 hours in advance so that a new appointment can be arranged. The office can be reached on 061 554 47 21 or at info@sla-basel.ch from Monday to Saturday. If absences are not reported or are not reported 24 hours before the lesson, the corresponding lesson will be charged and will not be rescheduled, as the teacher has been called in and the room has already been reserved. For lessons on Monday, the latest time for cancellation is 2 p.m. on the previous Saturday. In the event of illness and presentation of a doctor's certificate, the lesson will be rescheduled. 

In the event of a teacher's absence, the school management can arrange for a substitute. If this is not possible for organisational reasons, the lesson will be rescheduled. If this is also not possible, the costs for the cancelled lesson will not be charged. 

8. Organisation and implementation of private lessons

Each lesson lasts 45 minutes. For teaching reasons, a minimum of two lessons per session is required. In exceptional cases, a duration of 60 minutes per session is also possible after consultation before the course begins. 

The dates and lesson times can be agreed individually with the teacher. 

You are not entitled to a specific type of lesson, but you are welcome to make suggestions for improvement. 

There is no entitlement to choose the teacher. As a rule, all booked lessons are conducted by the same teacher. In the event of illness of the teacher or in exceptional cases, a change of teacher will take place. 

9. Course confirmation 

At the end of the private lessons, SLA Basel will issue course participants with a course certificate stating the number of lessons attended, if requested. 

10. Data Privacy 

Swiss Language Academy takes the protection of your personal data seriously and complies with the provisions of the Data Protection Act. Your personal data will be used exclusively for internal purposes such as correspondence and information about new offers. Under no circumstances will your personal data be sold or passed on to third parties. 

11. Insurance and liability 

Swiss Language Academy is liable for damage caused by gross negligence or intent, fraudulently concealed defects, physical injury, and unforeseeable defects that significantly impair the economic purpose of the legal transaction in connection with courses and events organised by it. For all other damage, in particular consequential damage, any liability is hereby excluded to the extent permitted by law. Customers are therefore responsible for ensuring that they have adequate insurance cover. Any liability for theft and loss of items is hereby excluded. 

12. Place of jurisdiction 

Unless otherwise required by mandatory legal provisions, the exclusive place of jurisdiction shall be Basel-Stadt.
